IRS Rides 1884 'Dead Horse' Law To Defense Of Tax Preparer Rules

WASHINGTON (Reuters) - The Obama administration on Tuesday defended its effort to regulate the tax return preparation business for the first time in U.S. history, basing its case largely on a 19th century law dealing with horses lost or killed in the Civil War.
At an appellate court hearing on a challenge brought by libertarian lawyers challenging the administration, Justice Department Tax Division lawyer Gilbert Rothenberg said: "I hate to beat a dead horse, especially one from the Civil War era."
But he explained that the administration sees the "Horse Act of 1884" as providing ample authority for the U.S. Internal Revenue Service to regulate the tens of thousands of preparers who fill out millions of Americans' federal tax returns.
A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit heard the administration's argument.
Rothenberg said the IRS should be allowed to force tax return preparers -- who are now unregulated -- to pass a competency test and take annual continuing education classes.
But the Institute for Justice, a libertarian advocacy law firm, disagreed.
"Congress never gave the IRS authority to regulate tax preparers," said Dan Alban, an attorney for the institute.
The case has broad implications for the industry, which includes H&R Block Inc., a few mid-tier companies and thousands of tiny, mom-and-pop firms.
A decision from the judges is still months away. In oral arguments, the judges -- all appointed by Republican presidents -- gave no clear sign of how they will rule, yea or neigh.
But they did question why the IRS was citing an 1884 law to justify trying to police tax return preparers in 2013.
LEGAL REPRESENTATION AT ISSUE
After the Civil War, many Americans brought war loss claims against the U.S. government, often for dead or missing horses.
A post-war industry emerged of agents who would press war loss claims for a fee, usually a percentage of the claim collected. Soon, claim values were being fraudulently inflated.
In response, the government started regulating these intermediaries, barring unscrupulous ones and certifying honest ones as "enrolled agents," a title that is still used today by people who represent clients in matters before the IRS.
The IRS is arguing that tax return preparers represent their customers in much the same way that enrolled agents do, so the agency should be able to expand regulation to include preparers.
But the Institute for Justice is arguing that tax return preparers do not carry out the same level of representation, but rather merely provide a paid service for clients.
"Preparing a tax return is not a representative act," Alban said. "It is performing a service, certainly, but there's no representation."
More than 78 million Americans in 2011 paid someone to prepare their tax returns. The industry posted estimated revenue this year of $9.4 billion.
The Institute sued in March 2012 to block the IRS's regulations and won a district court ruling in January halting parts of the agency's program. The IRS appealed.
KOCHS HELPED FUND CHALLENGER
Based in Arlington, Va., the institute litigates over issues such as private school vouchers and eminent domain. It was begun in 1991 with funding from wealthy industrialists and conservative activists David and Charles Koch.
Sabina Loving, a Chicago tax preparer, is the lead plaintiff in the case. She was not present at the oral arguments.
Some of the tax experts who attended said the judges seemed skeptical of the IRS's argument. "Clearly, they were leaning toward Loving," said Don Williamson, a tax accountant and executive director of American University's Kogod Tax Center.
"It looks like a good day for Mr. Alban," said Robert Kerr, senior director of government relations for the National Association of Enrolled Agents, a tax-preparers trade group.
Kathryn Keneally, head of the Justice Department tax division, declined to comment on the oral arguments while leaving the court room.
The case is Sabina Loving et al v. Internal Revenue Service, U.S. Court of Appeals for the District of Columbia Circuit, No. 13-5061.

Congress Voted Before To Repeal Medical Device Tax

WASHINGTON (AP) — Lawmakers on both sides of the Capitol already have overwhelmingly rejected the medical device tax that House Republicans insist on repealing as a condition for keeping the government open. It's just that those earlier votes didn't count.
Despite its unpopularity, both the White House and Senate Majority Leader Harry Reid, D-Nev., vowed this week they would not let Republicans make the tax a bargaining chip in averting a government shutdown on Tuesday. Republicans nonetheless put that chip on the table Saturday, along with a new demand to delay for a year making people buy medical insurance under President Barack Obama's health care law. The requirement goes into effect Jan. 1.
Reid, through a spokesman, called the idea of repealing the medical device tax as part of an anti-shutdown bill "stupid." ''The Senate will reject any (funding bill) that includes a repeal of the medical device tax," said Reid spokesman Adam Jentleson.
"Absolutely not," White House spokesman Jay Carney answered when asked if President Barack Obama would support repealing the tax.
The 2.3 percent tax, which took effect in January, is aimed at U.S. sales of medical devices used chiefly by doctors and hospitals, such as pacemakers and CT scan machines. Consumer items are exempted, including eyeglasses, contact lenses and hearing aids.
The tax was adopted as part of and intended to help pay for Obama's Affordable Care Act. Repealing it would cost the government an estimated $29 billion over the coming decade.
U.S. medical device companies employ about 400,000 people and boast sales of $130 billion annually. AdvaMed, the industry's largest trade group, says the tax is hurting job creation, reducing investment in medical innovation and increasing health care costs.

"The U.S. leads the world in medical technology, but the device tax threatens that leadership because it will put an additional burden on medical device innovators already struggling under the weight of America's uncompetitive tax system," the group says on its website. "The tax will be levied on medical device sales in the U.S. regardless of whether the company is making a profit."
Democrats counter that the new health care law will increase revenue for the industry by expanding health coverage to millions more people, helping offset the impact of the tax.
Democrats and Republicans in both the House and Senate have supported repealing the tax. Last year, 37 House Democrats voted with all 233 Republicans to repeal the tax. The bill passed the House, 270-146, but died in the Senate.
Many of the Democrats who favored the bill came from states like Minnesota, New York and California, which have a heavy presence of medical equipment makers.
In March, the Democratic-led Senate voted 79-20 to repeal the tax, but that measure was part of a nonbinding budget resolution. The vote, however, showed bipartisan support among senators for repealing the tax.
"It's got such strong support in both the House and Senate," said Rep. Kevin Brady, R-Texas, a senior member of the tax-writing House Ways and Means Committee. "It's a tax that makes no sense. In the weakest economic recovery since World War II, the president needs to be thinking about how you keep American jobs, not either kill them or send them overseas."
MTW- If the young folks coming out of college that were expected to pay for Obamacare, yet are unable for some reason, they have to find more money someplace. Sure, the young people cannot find a job, and have moved back in with the parents. They are healthy, a place to live and a career are on their minds. I am sure that they are most definitely chomping at the bit to pay exorbitant premiums for health insurance they do not want or need; if they decide not to enroll they will be fined? It sounds almost as if Obama is now a Police Officer pulling you over and giving you a monthly ticket for not having health insurance coverage. The medical device tax is absurd (the Democrat led Senate actually voted to repeal), and they have been collecting since January 2013? Where is the money going? It taxes things which are not even remotely related to the Medical Field. I wish more of our Doctors would stand together- and perhaps even some States’ Insurance Commissioners- if they had some kind of platform to educate their patients on the big downside of this law. The problem is, and I have tried to read the ACA myself. It is a confusing nightmare to read, even Einstein with his I.Q. of 160 would struggle, as it is so very long and incomprehensible not even our Physicians can make any sense of it. The Insurance Commissioners can understand it, and they are not speaking about it in a hopeful manner, at least the 2 or 3 I have heard. I also love the way Obama has given waivers to not only Congress and many federal employees but also some big businesses. The Unions are not happy. Jobs are being lost and the 40 hour work week is becoming a thing of the past. Obama DID NOT HAVE THE AUTHORITY to make his 19 changes to the ‘law of the land’ (shame on the Supreme Court) as it is to date. If it were a Republican House AND Senate this man would have been impeached long ago. If only he had been; instead, he is continuing his mission to destroy the Nation we so love and knew so well. It saddens me, as I spend 4 or 5 days every month at the doctor’s office, as I am disabled. The system is broken, for sure, but you do not replace it with a more costly one when expense was one of the initial complaints. More paperwork has been given at my visit a few days ago to sign away more of my HIPPA privacy rights, and if I had refused I feared that I may not get my treatment continued; they have me by the balls as I know I need at least 1 more surgery on my neck. I have Medicare, for now. He will come for that soon as well I am sure. Remember this quote? “If you like your plan, your doctor, you get to keep them”- Barack Obama. That is some of the very first BS Barack Obama gave us, along with all of this “change”. He might not have been elected either time if some folks had figured out what his context of the word change. I think he means to 'change' this Great Nation into a third world ghetto. Just my opinion after hundreds of doctor appointments and procedures over the last decade or so. I research as a writer. I now possess enough knowledge that it could enable me to pass the medical bar and treat my own self. Maybe not, but it certainly seems like it.

Poem By A Marine About The Heroes Of Benghazi: A Bump In The Road

"A bump in the road." Remember that calloused statement?
I don't know the author of this poem … received it today. Very thought provoking and poignant. I do recall, however, the President referring to the Benghazi incident as "a bump in the road." Today I heard an ex-Navy Seal being interviewed on Fox News regarding a book he has written about how to handle crisis situations in our lives. At the end of the interview he asked if he could make a comment on Benghazi and of course the anchor said yes. He then thanked Fox News for keeping the Benghazi story in the news, since other news organizations are not. He said the Seals who died deserve the public knowing the truth about the whole affair.
The poem was written by a MARINE CORPS Officer (ANON).

Muslim Brotherhood Forcing Egypt's Christians To Pay 'Submission' Tax

It looks like they didn’t stop after looting and burning dozens of churches in Egypt—now the Muslim Brotherhood and its supporters are forcing some Coptic Christians in Egypt to pay a jizya tax, author and translator Raymond Ibrahim reported on Sunday:
“…the Muslim Brotherhood and its supporters are forcing the roughly 15,000 Christian Copts of Dalga village in south Minya province to pay jizya — the money, or tribute, that conquered non-Muslims historically had to pay to their Islamic overlords “with willing submission and while feeling themselves subdued” to safeguard their existence, as indicated in Koran 9:29.”
All Copts in the village are being forced to pay “without exception,” according to Fr. Yunis Shawqi, who spoke this week to Dostor reporters in Dalga. He also said the “value of the tribute and method of payment differ from one place to another in the village, so that, some are being expected to pay 200 Egyptian pounds per day, others 500 Egyptian pounds per day…”
To put those figures in perspective, 200 Egyptian pounds is the equivalent of $29 per day, or $203 per week. Not exactly pocket change. So what happens if a family cannot afford to pay it?
"In some cases, those not able to pay have been attacked, their wives and children beaten and/or kidnapped. As a result, some 40 Christian families have now fled Dalga, joining the ever growing list of displaced Christians in the Middle East."
And this isn’t just happening in Egypt…
"It’s the same in Syria and Iraq. “Rebels” recently went to a Christian man’s “shop and gave him three options: become Muslim; pay $70,000 as a tax levied on non-Muslims, known as jizya; or be killed along with his family…. Androus from Mosul, Iraq… says he received a similar demand via telephone. ‘Because you are infidels, you have to pay jizya,’ he recalled being told over the phone. ‘Either you pay jizya, or we will kill you or your son.’”
MTW-Obama opened the door for the muslim brotherhood in Egypt just as Sean Hannity predicted, but did not call it what it was. A Military coup de ta which would end our funding of them. He gives billions of our tax dollars to countries that HATE us. Why? Poverty here is at an all-time high, there are more part-time jobs than full-time-60/40 which is back asswards and we are viewed by the World as weak because of his ineptitude in establishing foreign relations. You deny Fort Hood victims benefits by NOT calling Hassan's act "terrorism", and the Boston Marathon bombing is a "tragedy" just like Sandy Hook. How about the park shooting in Chicago by gangs? An AR-15 related accident? Then there is your taking away of the G.I. Bill away from our Soldiers, and acting so flippant about Snowden with the "I'm not going to scramble the jets. He's just a hacker" comment- Russia left him in the airport long enough to send the CIA to get him by the way, thank you President Putin. Your comments have done us nearly as much harm as your job destruction, your debt escalation, Syria's red-line that was not YOUR red-line, and Obamacare- which is killing the 40 hour work week. Bush was "Un-patriotic" for his 4.9 trillion increase to the deficit in two terms. When W. came into office, the debt was $5.73 trillion, and when he left after 8 years it was $10.63 trillion. In less than one term of your presidency you added over $5 trillion developing a "nanny" government, and we now are at a deficit of over $17 trillion. Are you Un-Patriotic? I do not think you ever were a TRUE Patriot. You do not seem to know American History, and those who do not know history are doomed to repeat it. Who goes to such lengths to hide their past but one with things to hide? You were never qualified for the job, but you bullshitted your path to the Oval Office. Kudos to you for destroying 232 years of work so swiftly. How about Obamacare? Healthcare is BAD ENOUGH without the government intrusion. If you're not shooting, you should be loading.

A Montana Woman Is Pissed Off At Senator Alan Simpson

Alan Simpson, the Senator from Wyoming calls 'Senior Citizens' the Greediest Generation as he compared "Social Security" to a Milk Cow with 310 million teats. Here's a response in a letter from PATTY MYERS in Montana. I think she is a little ticked off! She also tells it like it is.
"Hey Alan, let's get a few things straight!"
1. As a career Politician, you have been on the public dole (tit) for FIFTY YEARS.
2. I have been paying Social Security taxes for 48 YEARS (since I was 15 years old. I am now 63).
3. My Social Security payments, and those of millions of other Americans, were safely tucked away in an interest bearing account for decades until you political pukes decided to raid the account and give OUR money to a bunch of zero losers in return for votes, thus bankrupting the system and turning Social Security into a Ponzi scheme that would make Bernie Madoff proud.
4. Recently, just like Lucy & Charlie Brown, you and "your ilk" pulled the proverbial football away from millions of American seniors nearing retirement and moved the goalposts for full retirement from age 65 to age, 67. NOW, you and your "shill commission" are proposing to move the goalposts YET AGAIN.
5. I, and millions of other Americans, have been paying into Medicare from Day One, and now "you morons" propose to change the rules of the game. Why? Because "You idiots" mismanaged other parts of the economy to such an extent that you need to steal our money from Medicare to pay the bills.
6. I, and millions of other Americans, have been paying income taxes our entire lives, and now you propose to increase our taxes yet again. Why? Because you "incompetent bastards" spent our money so profligately that you just kept on spending even after you ran out of money. Now, you come to the American taxpayers and say you need more to pay off YOUR debt.
To add insult to injury, you label us "greedy" for calling "bulls..." to your incompetence.

1. How much money have you earned from the American taxpayers during your pathetic 50-year political career?
2. At what age did you retire from your pathetic political career, and how much are you receiving in annual retirement benefits from the American taxpayers?

4. What cuts in 'Your' retirement and healthcare benefits are you proposing in your disgusting deficit reduction proposal, or as usual, have you exempted yourself and your political cronies? It is you, Captain Bulls . . . and your political co- conspirators called Congress who are the "greedy" ones. As a Disabled American Citizen on Social Security (43 years old- received in '95 with 30 plus years averaged in as zero dollars, denied twice before) I am also offended by the “Entitlement” moniker added to my SS check. I worked hard for 15 years and it is MY MONEY, paid in over my career by myself and my employer(s). The government has now, as they have for years but to a greater extent appropriated OUR MONEY to use as they see fit as they dole it out to us at an insignificant amount nowhere near what it takes to live on. Congress should NOT receive full pay once they leave office. They also need term limits. Why are there several elderly Senators still serving in Congress? The mandatory retirement age- 65 formerly, and now 67 does not seem to apply to Congress (I will not name them, but we know who they are, senility on the left and the right), nor do any laws they pass to affect us apply to them- such as Obamacare. Hey, Pelosi, passing a Bill into Law so that “we can see what is in it” makes you sound quite the fool. Once you finally saw that it would affect you, your little Dem clique met with Obama in private- like the Affordable Care Act was created and continues to be worked on in the privacy of his underground bunker beneath the White House for some reason- for Congress and their aides to be exempted from it immediately before your yearly 5 week vacation. Do they deserve a vacation? They do very little "work" for us. It is good enough for us, but not you? Congress, you are all selfish and greedy save for a few good ones. We have the most divisive president, the most partisan socialist and his refusal to compromise with his OWN Countrymen, leaders speaking for US in Congress (the House Republicans), yet "negotiates" with Bashir al-Assad thanks to President Putin pulling his ass out of the jam his mouth got him into. People- criminals distributing malware is rapidly becoming more common these days. Be careful what you click on. I myself continue to receive e-mails from one of my own e-mail addresses to that very same address attempting to sell me Viagra (which I do not need) from several Canadian “pharmacies”. I thought DHS was scrutinizing all of our computer traffic. Why will they not put an end to this? They must need better hackers.

Quit Trashing Obama's Accomplishments!

He has done more things differently than any other President before him. Here is a list of his impressive accomplishments [in no particular order]:
1. First President to apply for college aid as a foreign student, then deny he was a foreigner.
2. First President to have a social security number from a state he has never lived in.
3. First President to by-pass Congress and implement the Dream Act through executive fiat.
4. First President to preside over a cut to the credit-rating of the United States.
5. First President to hide his medical, educational, [birth] and travel records.
6. First President to win a Nobel Peace Prize for doing NOTHING to earn it.
7. First President to go on multiple "global apology tours" and concurrent "insult our friends" tours.
8. First President to go on 17 lavish vacations (in his first four years in office), including date nights and Wednesday evening White House parties for his friends paid for by the taxpayers.
9. First President to have 22 personal servants (taxpayer funded) for his wife.
10. First President to keep a dog trainer on retainer for $102,000 a year at taxpayer expense.
11. First President to fly-in a personal trainer from Chicago at least once a week at taxpayer expense.
12. First President to repeat the Holy Quran & tell us the early morning call of the Azan (Islamic call to worship) is the most beautiful sound on earth.
13. First President to tell the military men and women that they should pay for their own private insurance because they "volunteered to go to war and knew the consequences." Then he was the First President to tell the members of the military that THEY were UNPATRIOTIC for balking at the last suggestion.
14. First President to side with a foreign nation over one of the American 50 states (Mexico vs. Arizona).
15. First President to violate the War Powers Act.
16. First President to be held in contempt of court for illegally obstructing oil drilling in the Gulf of Mexico.
17. First President to require all Americans to purchase a product from a third party. First President to spend a trillion dollars on "shovel-ready" jobs when there was no such thing as "shovel-ready" jobs.
18. First President to abrogate bankruptcy law to turn over control of companies to his union supporters.
19. First President to order a secret amnesty program that stopped the deportation of illegal immigrants across the U.S, including those with criminal convictions.
20. First President to demand a company hand-over $20 billion to one of his political appointees. (BP)

22. First President to terminate America’s ability to put a man in space.
23. First President to cancel the National Day of Prayer and to say that America is no longer a Christian nation.
24. First President to have a law signed by an auto-pen without being present.
25. First President to arbitrarily declare an existing law unconstitutional and refuse to enforce it.
26. First President to threaten insurance companies if they publicly spoke out on the reasons for their rate increases.
27. First President to tell a major manufacturing company in which state it is allowed to locate a factory.
28. First President to file lawsuits against the states he swore an oath to protect (AZ, WI, OH, IN).
29. First President to withdraw an existing coal permit that had been properly issued years ago.
30. First President to actively try to bankrupt an American industry (coal).
31. First President to fire an inspector general of AmeriCorps for catching one of his friends in a corruption case.
32. First President to appoint 35+ czars to replace elected officials in his office.
33. First President to surround himself with radical left wing anarchists.
34. First President to golf 73 separate times in his first two and a half years in office, 102 to date.
35. And he’s getting ready to go on another 7-9 day vacation – well deserved, don’t you think, after all his hard work accomplishing the aforesaid, incomplete list?
MTW- He did give us change, so he is not completely full of shit; he is simply a lazy slob (admittedly) and incompetent with a grandiose sense of entitlement with the matching ego upgrade from a do-no-legislation Senator. It sucks to be us right now, does it not America? On the bright side, I think his handicap is getting lower after all of the golfing. He finally did in his fifth year receive the award he deserves:

Thank you for taking the time to write. I have heard from many Americans regarding firearms policy and gun violence in our Nation, and I appreciate your perspective. From Aurora to Newtown to the streets of Chicago, we have seen the devastating effects gun violence has on our American family. I join countless others in grieving for all those whose lives have been taken too soon by gun violence.
Like the majority of Americans, I believe the Second Amendment guarantees an individual right to bear arms. In this country, we have a strong tradition of gun ownership that has been handed down from generation to generation. Hunting and sport shooting are part of our national heritage. Yet, even as we acknowledge that almost all gun owners in America are responsible, when we look at the devastation caused by gun violence—whether in high-profile tragedies or the daily heartbreak that plagues our cities—we must ask ourselves whether we are doing enough.
While reducing gun violence is a complicated challenge, protecting our children from harm should not be a divisive one. Most gun owners agree that we can respect the Second Amendment while keeping an irresponsible, law-breaking few from inflicting harm on a massive scale. Most also agree that if we took commonsense steps to curtail gun violence, there would be fewer atrocities like the one that occurred in Newtown. We will not be able to stop every violent act, but if there is even one thing we can do to reduce gun violence—if even one life can be saved—then we have an obligation to try.
That is why I asked Vice President Joe Biden to identify concrete steps we can take to keep our children safe, help prevent mass shootings, and reduce the broader epidemic of gun violence in this country. He met with over 200 groups representing a broad cross-section of Americans and heard their best ideas. I have put forward a specific set of proposals based off of his efforts, and in the days ahead, I intend to use whatever weight this office holds to make them a reality.
My plan gives law enforcement, schools, mental health professionals, and the public health community some of the tools they need to help reduce gun violence. These tools include strengthening the background check system, helping schools hire more resource officers and counselors and develop emergency preparedness plans, and ensuring mental health professionals know their options for reporting threats of violence. And I directed the Centers for Disease Control to study the best ways to reduce gun violence—because it is critical that we understand the science behind this public health crisis. From improving mental health services to looking more closely at a culture that too often glorifies violence, we must leave no stone unturned when working to keep Americans safe.
As important as these steps are, they are not a substitute for action from Congress. To make a real and lasting difference, members of Congress must also act. As part of my comprehensive plan, I have called on them to pass some specific proposals right away. First, it is time to require a universal background check for anyone trying to buy a gun. Second, Congress should renew the 10-round limit on magazines and reinstate and strengthen the assault weapons ban. We should get tougher on those who buy guns with the purpose of selling them to criminals, and we should impose serious punishments on anyone who helps them do this.
These are reasonable, commonsense measures that have the support of the majority of the American people. But change will not come unless the American people demand it from their lawmakers. Now is the time to do the right thing for our children, our communities, and the country we love. We owe the victims of heartbreaking national tragedies and the countless unheralded tragedies each year nothing less than our best effort—to seek consensus in order to save lives and ensure a brighter future for our children.

The IRS is targeting the Right, with help from the ATF, EPA, OSCHA and the FBI. He is preparing to start World War III by aiding the rebels in Syria, most of whom are our enemies, because he made a foolish statement. He has a standard form letter for any and all gun control questions. I fear we will need them before he is finished. They did not even bother to put at minimum an electronic signature on this letter. This Country becomes less free by the day. Do not let him use Newtown, Aurora or Chicago-and now the Navy Yard Massacre, (with the left wing media having an AR-15 in Alexis' hand before it was confirmed as a SOTGUN) to further his personal agenda to subvert the Constitution and the Second Amendment. He loves to use tragedies in peoples' lives and crimes to accomplish his goals, with little actual care for them, only his self image. The criminals are the ones we need guns to protect ourselves from, as their right to own a gun is not under attack. He is more divisive than this issue, and I am sure you read that Vice President Joe Biden is going to "identify concrete steps we can take to keep our children safe....". That is a parent's job, not the president's. Joe Biden told us all to buy a shotgun, apparently Aaron Alexis did, and fire it into the air to frighten away intruders. As that is illegal, can we get someone with a brain to work on this? How will we be protected from the alphabet soup of government agency acronyms coming to intimidate Tea Party members at the behest of the IRS? They- And I am one of them- have a Constitutional RIGHT for tax-exemption AND FREEDOM OF ASSOCIATION. One more thing. I am SO tired of hearing Democrats screaming about background checks at gun shows. Come to Florida. They ALREADY DO THE BACKGROUND CHECKS AT THE GUN SHOWS. Ignorance tends to anger me. People getting checked are often extremely pissed off when they do not pass, or if they pass, the 3 day waiting period angers them. Either way, they do better background checks than the government did on, let's see, Edward Snowden, Bradley Manning (or Chelsea?) and Aaron Alexis. All had SECURITY CLEARANCE after a background check from the same company. But hey, when you give 4 million folks a security clearance a few nuts fall through the cracks. Right? At A Tennessee Football Game- Not A Joke

Christianity is the continuing target of persecution.
I FIND IT INTERESTING THAT A HIGH SCHOOL PRINCIPAL CAN SEE THE PROBLEM, BUT OUR SOCIETY CANNOT.

This is a statement that was read over the PA system at the football game at Roane County High School, Kingston, Tennessee, by school principal, Jody McLeod:
"It has always been the custom at Roane County High School football games, to say a prayer and play the National Anthem, to honor God and Country.
Due to a recent ruling by the Supreme Court, I am told that saying a Prayer is a violation of Federal Case Law. As I understand the law at this time, I can use this public facility to approve of sexual perversion and call it "an alternate life style" and, if someone is offended, that's OK.
I can use it to condone sexual promiscuity, by dispensing condoms and calling it, "safe sex".
If someone is offended, that's OK.
I can even use this public facility to present the merits of killing an unborn baby as a "viable" means of birth control.
If someone is offended, no problem.
I can designate a school day as "Earth Day" and involve students in activities to worship religiously and praise the goddess, "Mother Earth", and call it "ecology".
I can use literature, videos and presentations in the classroom that depicts people with strong, traditional Christian convictions as "simple minded" and "ignorant" and call it "enlightenment".
However, if anyone uses this facility to honor GOD and to ask HIM to bless this event with safety and good sportsmanship, then Federal Case Law is violated.
This appears to be inconsistent at best, and at worst, diabolical.
Apparently, we are to be tolerant of everything and anyone, except GOD and HIS Commandments.
Nevertheless, as a school principal, I frequently ask staff and students to abide by rules with which they do not necessarily agree.
For me to do otherwise would be inconsistent at best, and at worst hypocritical.
I suffer from that affliction enough unintentionally.
I certainly do not need to add an intentional transgression.
For this reason, I shall "Render unto Caesar that which is Caesar's", and refrain from praying at this time.
However, if you feel inspired to honor, praise and thank GOD and ask HIM, in the name of JESUS, to bless this event, please feel free to do so. As far as I know, that's not against the law--yet."
One by one, the people in the stands bowed their heads, held hands with one another and began to pray.
They prayed in the stands.
They prayed in the team huddles.
They prayed at the concession stand and they prayed in the Announcer's Box!
The only place they didn't pray was in the Supreme Court of the United States of America- the Seat of "Justice" in the "One Nation Under GOD."
Somehow, Kingston, Tennessee, remembered what so many have forgotten.
We are given the Freedom OF Religion, not the Freedom FROM Religion.
Praise GOD that HIS remnant remains!
JESUS said, "If you are ashamed of ME before men, then I will be ashamed of you before MY FATHER".
Will Jesus be ashamed of you? I am a born again Christian, and I will not be silent.

Obama: 'I Didn't Set A Red Line' on Syria

Recasting his role in setting a “red line” on Syria, President Barack Obama insisted on Wednesday that Congress and the world will lose credibility if Bashar Assad’s alleged chemical weapons massacre goes unpunished.
“My credibility’s not on the line. The international community’s credibility is on the line, and America and Congress’ credibility is on the line,” Obama said during a visit to Stockholm, Sweden.
“I do have to ask people, well, if, in fact, you’re outraged by the slaughter of innocent people, what are you doing about it?” Obama asked. “The moral thing to do is not to stand by and do nothing.”
The president rejected any notion that he needs to use military force against Syria in order to preserve his personal standing in the world after calling a chemical weapons attack a “red line” in an Aug. 20, 2012, press conference.
“I didn’t set a red line. The world set a red line,” he insisted. “The world set a red line when governments representing 98 percent of the world’s population said the use of chemical weapons are abhorrent and passed a treaty forbidding their use even when countries are engaged in war.”
And “Congress set a red line when it ratified that treaty. Congress set a red line when it indicated, in a piece of legislation titled the Syria Accountability Act, that some of the horrendous things that are happening on the ground there need to be answered for,” he added.
The Chemical Weapons Convention, which Syria never signed, does not call for unilateral military force in response to violations by countries not party to the treaty. The Syria Accountability Act imposes tough economic sanctions on Syria, but it does not envision unilateral military force. And Obama mentioned neither in his fateful remarks one year ago.
Still, Obama insisted on Wednesday, “that wasn’t something I just kind of made up. I didn’t pluck it out of thin air. There’s a reason for it.”
His arguments recalled then-President George W. Bush’s warnings in the runup to the invasion of Iraq that world credibility was on the line because of a series of U.N. Security Council resolutions warning Saddam Hussein about possessing weapons of mass destruction, and Bush’s insistence that Congress’ credibility was at stake because it passed the Iraq Liberation Act that made “regime change” official U.S. policy.
Syria braces for tough response from West.

“I’m very mindful of the fact that around the world and here in Europe in particular, there are still memories of Iraq,” Obama said.
“Keep in mind, I’m somebody who opposed the war in Iraq and am not interested in repeating mistakes of us basing decisions on faulty intelligence,” he added. “We believe very strongly, with high confidence, that in fact chemical weapons were used and that Mr. Assad was the source.”
Obama’s comments came as the deeply divided Congress wrestled with whether to approve legislation granting him authorization to use force against Syria.
Asked what he would do if lawmakers rejected the measure, Obama bluntly told lawmakers that he does not need their permission to strike Syria. And he challenged Congress to do more than “sit on the sidelines (and) snipe.”
“As commander in chief, I always preserve the right and the responsibility to act on behalf of America’s national security. I do not believe that I was required to take this to Congress,” Obama said.
“But I did not take this to Congress just because it’s an empty exercise; I think it’s important to have Congress’s support on it,” Obama said at a press conference with Swedish Prime Minister Fredrik Reinfeldt.
The president expressed confidence that Congress will ultimately give him its green light for military action against the Syrian president’s forces, whom Washington accuses of massacring civilians with chemical weapons on Aug. 21.
“I believe Congress will approve it,” he said.
“We can send a very clear strong message in favor of the prohibition against using chemical weapons. We can change Assad’s calculus about using them again. We can degrade his capabilities so that he does not use them again,” Obama said.
“What I’m talking about is an action that is limited in time and in scope, targeted at the specific task of degrading his capabilities and deterring the use of those weapons again,” the president said.
And Obama said Congress must be more invested in the use of American military force abroad — at least when American national security, or that of an ally's, is not directly and imminently threatened.
“It’s important for us to get out of the habit of just saying, ‘well, we’ll let the president kind of stretch the boundaries of his authority as far as he can. Congress will sit on the sidelines, snipe. If it works, the sniping will be a little less. If it doesn’t, a little more.' But either way, the American people and their representatives are not fully invested in what are tough choices,” Obama said.

UPDATE: I am currently watching Obama stammer through his justification of a Syria attack while he is at the G-20 Summit. No teleprompter. He said "when I strike". I? You are not the embodiment of the United States sir, when you have laid the blame on Congress to act or not. Unilateral action taken by you is looking more and more likely. Business as usual for your administration, it would seem. We this. We that. "We told other countries that Assad should not be doing this". This man has no clue about foreign relations. Putin plans to attack Saudi Arabia if we strike Syria. Great. Putin is like a shark who smells blood in the water whenever Obama is his adversary. He does not respect this president. The rebels in Syria (al-qaeda)- are torturing and executing their opponents, eating hearts cut from dead men's chests, and summarily torturing and executing Syrian Army soldiers they have captured, filming it all. Do we really want to help propagate that? Cut the head off of the snake and attack Iran. What are the Joint Chiefs thinking? Our Military has been SLASHED by this administration, and they are not respected by Obama, until now when he needs them. No boots on the ground. Days, not weeks. No regime change. Unbelievable. Early Look At Health Care Law's Premiums

Chart shows what health insurers are anticipated to charge in various states for coverage under the Affordable Care Act
WASHINGTON (AP) -- The No. 1 question about President Barack Obama's health care law is whether consumers will be able to afford the coverage. Now the answer is coming in.
The biggest study yet of premiums posted by states finds that the sticker price for a 21-year-old buying a mid-range policy will average about $270 a month. That's before government tax credits that act like a discount for most people, bringing down the cost based on their income.
List-price premiums for a 40-year-old buying a mid-range plan will average close to $330, the study by Avalere Health found. For a 60-year-old, they were nearly double that at $615 a month.
Starting Oct. 1, people who don't have health care coverage on their job can go to new online insurance markets in their states to shop for a private plan and find out if they qualify for a tax credit. Come Jan. 1, virtually all Americans will be required to have coverage, or face fines. At the same time, insurance companies will no longer be able to turn away people in poor health.
The study points to the emergence of a competitive market, said lead author Caroline Pearson, a vice president of the private data analysis firm. But it's a market with big price differences among age groups, states and even within states. A copy was provided to The Associated Press.
The bottom line is mixed: Many consumers will like their new options, particularly if they qualify for a tax credit. But others may have to stretch to afford coverage.
"We are seeing competitive offerings in every market if you buy toward the low end of what's available," said Pearson, a vice president of Avalere.
However, for uninsured people who are paying nothing today "this is still a big cost that they're expected to fit into their budgets," Pearson added.
The Obama administration didn't challenge the study, but Health and Human Services spokeswoman Joanne Peters said consumers will have options that are cheaper than the averages presented. "We're consistently seeing that premiums will be lower than expected," she added. "For the many people that qualify for a tax credit, the cost will be even lower."
With insurance marketplaces just weeks away from opening, the Avalere study crunched the numbers on premiums filed by insurers in 11 states and Washington, DC.
Eight of them are planning to run their own insurance markets, while the federal government will run the operation in the remaining four. There were no significant differences in premiums between states running their own markets and federal ones.
The states analyzed were California, Connecticut, Indiana, Maryland, New York, Ohio, Rhode Island, South Dakota, Vermont, Virginia and Washington. No data on premiums were publicly available for Texas and Florida — together they are home to more than 10 million of the nation's nearly 50 million uninsured people — and keys to the law's success.
However, Pearson said she's confident the premiums in the study will be "quite representative" of other states, because clear pricing patterns emerged. Official data for most other states isn't expected until close to the Oct. 1 deadline for the new markets.
The study looked at premiums for non-smoking 21-year-olds, 40-year-olds and 60-year-olds in each of the 11 states and the District of Columbia.
It compared four levels of plans available under Obama's law: bronze, silver, gold and platinum. Bronze plans will cover 60 percent of expected medical costs; silver plans will cover 70 percent; gold will cover 80 percent, and platinum 90 percent.
All plans cover the same benefits, but bronze features the lowest premiums, paired with higher deductibles and copays. Platinum plans would have the lowest out-of-pocket costs and the highest premiums.
Mid-range silver plans are considered the benchmark, because the tax credits will be keyed to the cost of the second-lowest-cost silver plan in a local area.
The average premium for a silver plan ranged from a low of $203 a month for a 21-year-old in Maryland to a high of $764 for a 60-year-old in Connecticut.
The silver plan premiums for 40-year-olds were roughly $75 a month higher than for 21-year-olds across the states. But the price jumped for 60-year-olds. The health law allows insurers to charge older adults up to three times more than younger ones. That's less of a spread than in most states now, but it could still be a shock.
"It's striking that the curve increases quite dramatically above age 40," said Pearson. "As you get older and approach Medicare age, your expected health costs start to rise pretty quickly."
But older consumers could also be the biggest beneficiaries of the tax credits, because they work by limiting what you pay for health insurance to a given percentage of your income.
For example, an individual making $23,000 would pay no more than 6.3 percent of their annual income — $1,450 — for a benchmark silver plan.
That help tapers off for those with solid middle-class incomes, above $30,000 for an individual and $60,000 for a family of four. The study also found some striking price differences within certain states, generally larger ones. In New York, with 16 insurers participating, the difference between the cheapest and priciest silver premium was $418.
MTW-How can there be a mid-range plan when it is an even number of plans? Bronze, Silver, Gold and Platinum. The government sounds like a high interest rate credit card company attempting to sell you with the name of your plan by including a precious metal. They are setting the bar extremely low in DC. It starts at the top with Obama, and we now see the trickle down screwing over of Americans by their own representatives. How is this health care act affordable? The young people, and a large portion of all ages are UNEMPLOYED because of this law. How are the unemployed supposed to pay? The 40 hour work week is no more, as businesses cannot afford to carry full time workers. Who decided to FINE a person for choosing not to be insured? Where is our freedom? Does it apply equally to us, as well as Congress? No. What about the illegal immigrants? Muslims? Christian Scientists? Scientologists? Amish? No. Is that why the cost is high? "If you like your current plan, don't worry. You can keep it."- Barack Obama, 2009 BS. I hope the liberals are happy and proud of our liar-in-chief. He is not worried. If he was he would not be able to golf, that damned job of his getting in the way. I am sure there is a golf course wherever he goes. He must have his very own golf course/travel czar to enable Obama's addiction to golf. Many Americans do not know what to do, and are very angry about Obamacare. I am one of those Citizens. This vacation tradition was started in 1790, as there was no air conditioning then. The Capitol building has had A/C since 1950 you pack of lazy #@%$^%s. The medical care system in this Nation is screwed up enough without this particular president wanting his signature legislation rammed down our throats. This ACA is going to make things better? Doubtful, as Obama has no track record of successful policy, only bypassing Congress. This is a huge gamble. When will you remove Medicare from us? That seems to be the direction we are going. Our Social Security checks now say "Federal Benefit Check". What??? I and my former employers paid money into Social Security, and you have changed it from OUR money to an entitlement. Big government is out to control every aspect of our lives.

Father Thrown Out Of Universal Studios Over A T-Shirt

A teenager's sweet 16 birthday party was cut short recently when she and her family were kicked out of a Universal Studios in Orlando. The reason? Her father's T-shirt.
According to WPTV, a local news station in West Palm Beach, Florida, on August 24th, Christian Jarosz, his wife Diana, their daughter Sabrina, and her friend were stopped by security while they were headed to the Blue Man Group show inside the theme park. "They kicked me out because of my T-shirt," Christian told WPTV.
The shirt in question: A navy blue T with the words, "Police" and underneath, "Street Crime Unit." Christian is not a police officer but his brother-in-law, a New York cop, had given him the shirt as a gift. Although Christian says he has previously worn the shirt to Disney World as well as other theme parks, officers stopped Christian to tell him that he could not wear the shirt in the park.
The family asked to see the policy in writing and questioned the order. They also offered to have the security officers follow them to Billabong, a clothing store inside the park, so they could buy another T-shirt. However, more security officers showed up and told Christian not to bother buying another shirt because he needed to leave the park.

The family left and although they were refunded the $500 they spent on tickets for the Blue Man Group, they say they won't return to Universal Studios again. "They even threatened to arrest us. That really terrified me. I run a school! I've never done anything against the law," Diana told WPTV.
Yahoo Shine could not reach the Jarosz family for comment and a rep from Universal Studios did not return Yahoo Shine's email, however a spokesperson for Universal Studios Orlando emailed the following statement to WPTV: "The only people we allow in our parks with shirts or other clothing that might identify them as police officers are working law enforcement personnel. This is for everyone's safety and to avoid confusion by our guests. And while we don't discuss specific guest situations, I can tell you it is our practice to clearly explain policy decisions to our guests—and it is not our practice to ask guests to leave our theme parks simply because they ask us questions. I'd invite these guests to contact us if they'd like to have a conversation about what happened."
There's been no shortage of T-shirts bearing controversial statements recently. In January, NBC reported that while on Qantas Airlines flight from Sydney to Auckland, Australia, a man named Wynand Mullins was asked to remove his T-shirt, which read, "Hello.
My name is Inigo Montoya. You killed my father. Prepare to die." The phrase is a popular quote from the 1987 film "Princess Bride."
Mullins told Stuff, a news outlet in New Zealand, that a flight attendant asked him to remove his shirt because passengers were intimidated by the slogan, but she let the matter drop when he told her that he didn't have another shirt.
This past April, following the fatal bombings at the Boston Marathon, Nike realized that one of its T-shirts for New York Yankee fans —which bore the words "Boston Massacre" along with blood spatter—had disastrous timing. The company quickly pulled the products from store shelves, but not before photos of the shirt appeared online. And most recently, in August, online retailer The Children's Place pulled a girl's T-shirt from its shelves after a public outcry over the shirt's slogan which had a checklist that read, "My Best Subjects: Shopping. Music. Dancing. Math." All the boxes were checked off, except "math."
MTW-Our little girls are being indoctrinated into idiocy with these foolish T-shirts. That said, is this no longer a free country? Parents do not have to clad their daughters in clothing highlighting their total lack of intelligence. Now why is someone kicked out of Universal Studios for wearing a shirt with a police caption? Is it not sleazy enough? Wake up America. The liberal atheists are out to damn your soul. God help us all.

Sorry McDonalds Lovers: Yucky News

Hamburger chef Jamie Oliver has just won a battle against one of the largest fast food chains in the world. After Oliver showed how McDonald’s hamburgers are made, the franchise announced it will change its recipe.
According to Oliver, the fatty parts of beef are “washed” in ammonium hydroxide and used in the filling of the burger. Before this process, according to the presenter, the food is deemed unfit for human consumption.
According to the chef and presenter, Jamie Oliver, who has undertaken a war against the fast food industry: “Basically, we’re taking a product that would be sold in the cheapest way for dogs, and after this process, is being given to human beings.”
Besides the low quality of the meat, the ammonium hydroxide is harmful to health. Oliver calls it “the pink slime process.”
“Why would any sensible human being put meat filled with ammonia in the mouths of their children?” asked the chef, who wages a war against the fast food industry.
In one of his initiatives, Oliver demonstrates to children how nuggets are made. After selecting the best parts of the chicken, the remains (fat, skin and internal organs) are processed for these fried foods.
The company, Arcos Dorados, the franchise manager in Latin America, said such a procedure is not practiced in the region. The same applies to the product in Ireland and the UK, where they use meat from local suppliers.
In the United States, Burger King and Taco Bell had already abandoned the use of ammonia in their products. The food industry uses ammonium hydroxide as an anti-microbial agent in meats, which has allowed McDonald’s to use otherwise “inedible meat.”
Even more disturbing is that because ammonium hydroxide is considered part of the “component in a production procedure” by the USDA, consumers may not know when the chemical is in their food.
On the official website of McDonald’s, the company claims that their meat is cheap because, while serving many people every day, they are able to buy from their suppliers at a lower price, and offer the best quality products.
In addition, the franchise denied that the decision to change the recipe is related to Jamie Oliver’s campaign. On the site, McDonald’s has admitted that they have abandoned the beef filler from its burger patties.
MTW-On 8-26-2012, I wrote a blog entitled "Why Does The US Government Serve Our Children Dog Food Grade Beef?", which is still in my archives. I am delighted that many of the companies using this garbage have changed their ways, but not all. Not yet. This may be the reason I will not consume McDonalds beef (if you can call it that).
